CCPA NOTICE AT COLLECTION TO APPLICANTS


Please take notice that Day-Lee Foods, Inc. (“the Company”) collects certain personal information about you through the Employment Application Form. This notice describes the categories of personal information the Company collects and the purposes for which they are used in accordance with the California’s California Consumer Privacy Act (CCPA), including as amended by the California Privacy Rights Act (collectively, “CCPA”).


The law provides California residents with certain rights with respect to the personal information collected from them, including the rights: 


  • To delete personal information. 
  • To correct inaccurate personal information. 
  • To access personal information. 
  • To know what personal information is sold or shared and to whom. 
  • To opt out of selling or sharing of personal information. 
  • To limit use and disclosure of sensitive personal information. 
  • Not to be discriminated or retaliated against for exercising rights under the law. 


The categories of personal and sensitive personal information under the CCPA that we may collect from applicants through the Employment Application Form:


  • Identifiers (name, postal address, and initial),
  • Personal information under Civil Code Section 1798.80 (name, signature, address, education, employment history) 
  • Characteristics of protected classifications under California or federal law (age, military/veteran status, disability, and request for medical conditions), and
  • Professional or employment-related information (employment history, unemployment history, degrees, special training, and skills)


The above list does not necessarily mean that the Company collects all information listed in a particular category for all of job applicants.


We do not use or disclose Sensitive Personal Information for the purpose of inferring characteristics of employees.


Personal information does not include “publicly available information or lawfully obtained, truthful information that is a matter of public concern.”


Other exceptions to the CCPA include medical information governed by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) or California’s Confidentiality of Medical Information Act, information collected under the Fair Credit Reporting Act and information held by financial institutions.


How your personal information is used.

We may use personal information for the following purposes:


  • Identification,
  • Recruiting employees,
  • Confirming eligibility, and
  • Complying with applicable federal and state law.


We may or may not have used personal information about you for each of the above purposes. 


Selling or sharing of personal information

For purposes of the CCPA, the Company does not sell or share the personal information or sensitive personal information of job applicants. 


Data retention 

The Company retains the information it receives about you for the entire duration of your employment relationship with the Company and for as long thereafter as permitted or required by applicable law. If not hired, the Company will retain information of applicants for four years after the record is collected.
